Your correspondence to Ms. Jessica Littlewood, MLA for Fort Saskatchewan-Vegreville, has been forwarded to me for response in my role as Minister of Alberta Justice and Solicitor General. I am pleased to provide the following information.

I have been informed by my officials at Transcript Management Services that there was uncertainty regarding the nature of the matter for which you were requesting a transcript. In June 2016, a Notice to the Profession and Public regarding Civil and Family Case Management was issued by the Court of Queen's Bench. A copy of that Notice is attached for your reference. The Notice provides that transcripts of hearings before Case Management Counsel are not available except as permitted by the Chief Justice, the Associate Chief Justice, or the Case Management Justice (or when the Case Management Counsel is acting as a referee under rule 6.44 to 6.46 of the Alberta Rules of Court). Further, I understand that transcripts of Case Management Conferences before the Case Management Justice are not available without further order of the Case Management Justice.

However, as you have indicated in your correspondence, the October application for which you were seeking a transcript was neither a Case Management Counsel hearing nor a Case Management Conference, but rather an application before your Case Management Justice, Honourable Justice K.M. Horner. As a result, Transcript Management Services has obtained clarification that your original transcript request can be processed.

As the funds from your initial request were still on file, Transcript Management Services processed the transcript and sent you a copy on February 8, 2017.
